Validity of a gift to a defunct charity

The Court has recently had to examine the issue as to whether, in the case of a defunct charity, a bequest could pass to another similar charity. 

It was held that the organisation has to continue beyond the death of the donor for the gift to apply and that otherwise there would be a partial intestacy.
