Claims against Professionals

Disputes involving Trusts and Estates

These disputes fall into a number of categories and can be complex in nature. An Application can be made to challenge a Will in the event that it is improperly executed or if it is alleged that somebody made a Will under duress or while they were incapable of understanding what they were doing. In certain circumstances, a caveat can be lodged to prevent the administration of an Estate.

A claim can also be made against an Estate in the event that the Testator failed to make ‘reasonable financial provision’. The categories of people potentially able to apply to the Court under the Inheritance (Provision for Family and Dependants) Act 1975 are as follows:-

• The spouse or civil partner of the deceased
• A former spouse of civil partner, but not one who has formed a subsequent marriage or civil partnership
• A partner who lived with the deceased for at least 2 years immediately before their death
• A child of the person who made the Will, or somebody who was treated as a child
• Any other person who immediately before the death was being maintained either wholly or partly by the deceased.
