Project Managing Large Disputes

There is a perception within some organisations within the market place that "big ticket" litigation can only be handled in the City, with City charging rates to match. Thankfully, that is a rapidly fading perception. We are seeing more and more commercial disputes that may once have had an exclusively City badge moving out of the square mile. Construction and engineering disputes have been recent cases in point.

Rawlison Butler LLP has the experience, know how and resources to project manage large commercial disputes both in England and internationally. Where there is a multi jurisdictional angle to the case, we will go to the most suitably equipped associate in each jurisdiction to handle the case under our co-ordination, rather than being saddled with whoever you might get from the international law firm's local law office. We are also regularly called upon by professional colleagues in Europe and North America to assist with matters that have a UK dimension.

Clients of whatever stature always want value for money, and progressively they are seeing that they can get this outside the City.

To say that Rawlison Butler LLP can handle these types of cases is no idle boast. The two lead partners in the Commercial Disputes Department both have extensive experience with highly respected City firms, but are now in a position to handle your case at non City rates. To put this into context, our partner rates will range from a base figure of £220 per hour to a maximum of £240 per hour. In the City, that will buy you a very junior assistant at best. In terms of track record, we set out below some recent case studies:

  • Acting for major international travel portal client in respect of issues arising out of major outsourcing contract and the successful resolution of those issues.
  • Acting for the UK and European based subsidiaries of a major multi-national corporation involved in the worldwide production and sale of machinery in relation to various product liability claims in the English High Court arising out of power plant and marine application.
  • Successfully defending claim against French engineering company brought by plc in respect of supply of goods. Trial 2003 in Technology and Construction court - indemnity costs awarded in client's favour.
  • Advising UK motor vehicle distributor on contractual liability of parties responsible for unfair distribution at work following contract renewal procedures.
  • Acting for Ireland/USA based international manufacturer (in co-operation with New York based lawyers) in respect of shareholder dispute with UK based insolvent company including representing interests in contested insolvency and in respect of purchase of assets from Liquidator.
  • Advising a major creditor of BCCI concerning the settlement of all claims and cross claims within the Liquidators, issuing detailed cross-border procedures for approving and adjudicating on the process.
  • Continuing to act and advise the European subsidiaries of a major Japanese based manufacturer of broadcast television camera systems in relation to anti-dumping issues.
  • Liaising with major US firm advising on jurisdictional issues in relation to potential action on behalf of EU based importers against foreign (non EU) government for breach of warranty in relation to preferential duty.
  • Successful initiation and negotiation of 6 party mediation of long running claim for contamination of UK petrol station site redeveloped for residential use, including chain of indemnity claims and misrepresentation counterclaim brought by 5 successive owners between themselves as well as the principal claim brought by adjacent landowners.
  • Advising a leading Foreign (European) football club on matters relating to the transfer of a high profile player to a leading UK Premier league club.
  • Representing a leading South American Football club in defence of proceedings relating to the transfer of a high profile player to a leading UK Premier League Football Club.
  • Advising a UK Company on all aspects of the dismissal of a minority shareholder director including in relation to implications arising from related shareholder disputes.
