Solicitors must ensure that they act in the best interests of their client with the appropriate level of skill, knowledge and experience.
Here are some examples of professional negligence claims:
- Solicitors must ensure that their client has capacity when making their Will; otherwise, the Will can be challenged. The executor may seek to recover any loss incurred by the estate from the firm of solicitors who drafted the Will.
- Sometimes the executed Will does not correspond with the instructions of the testator and an application must be made to the court to rectify the Will. The executor may look to recover the cost of this application and any loss incurred as a result of the error from the firm of solicitors who drafted the Will.
