There are numerous ways that you could have been injured – you might have had an accident at work, been involved in a road traffic accident, tripped on an uneven paving slab or developed a physical or psychological injury due to your work conditions.  The list is endless.

What will I get?

Essentially, the object of a personal injury claim would be to put you in the same position financially as you would have been in had the accident not happened.  If you are entitled to compensation, your claim will be dealt with on two bases – compensation for the pain and suffering you have endured, and then reimbursement of any expenses you have or may incur as a result.  This can include loss of earnings and future loss of earnings, travel expenses, car hire charges, compensation for loss of enjoyment of a holiday or loss of the opportunity to follow your chosen career.  The scope is very wide. 

How much does it cost?

Legal Aid is no longer generally available for personal injury claims.

In its place, “No Win, No Fee” agreements are gaining in popularity.  This type of agreement allows the client and his/her lawyer to share the costs risks.

If you lose, you do not have to pay your lawyer anything.  You would be responsible for the other side’s costs but most Conditional Fee Agreements are backed by an insurance policy to cover this liability.  Making a claim for compensation for personal injury does not have to be a stressful and costly experience. 

What you should do first

It is important to take legal advice reasonably quickly after an accident.  In most cases, you only have three years from the date of the accident in which to start Court proceedings otherwise your claim will be disallowed.
