Divorce and separation - frequently asked questions

Question

Will I have to stay in the family home while divorce proceedings are going through?

Answer

If your ex has not been violent (and this does not have to be extreme violence), and they do not leave voluntarily, then you will both have to stay in the family home until Decree Absolute and the financial settlement is reached.

Many couples have to do this and in the vast majority of cases it can work.  On the other hand, it is also possible to leave your ex in the family home and vacate yourself.  If you do this you do not necessarily have to pay all the bills on the family home if for example you find yourself having to pay rent.  If there are children however, the matter is more complicated and advice should be sought first.
