What can I do when my ex won’t let me see the children?
Answer
Sometimes a letter to your ex will be sufficient but where it is not, there are a number of tools under the Children Act which you can use to obtain Court Orders for seeing the children, having a say as to their education, where they live, their upbringing, where they go on holiday etc.
The Court wants to support the relationship between a child and the absent parent. It will do its best to ensure that, for example, contact is established and takes place regularly. You should not be ‘blackmailed’ by your ex who may try to barter maintenance for contact. The two are not connected.
In extreme cases, the Court can award residence of a child to an absent parent when it appears the most appropriate option. (Residence = with whom the children live on a day to day basis)
