Divorce and separation - frequently asked questions
Question
I am afraid that if I let my ex see the children that he/she won’t return them to me. What can I do?
Answer
This is a common concern. In the first instance it is best for a Solicitor to correspond with the ex to try and establish a regime for contact and safeguards. For example to begin with it might be more appropriate for contact to be supervised.
If despite such safeguards, your ex does keep the child and not return them then it is advisable to make an Application to Court straightaway under the Children Act for return of child. Such an Application should not be delayed.
