Question

If I start divorce proceedings but remain in the property with my husband/wife, I am afraid that he/she will bully and harass me and possibly be violent.    What should I do?

Answer

This is a common anxiety.  In the vast majority of cases, the fear is unfounded. 

When a Solicitor’s letter is written to the ex it often brings that person into the ‘real world’.  That is, they realise that it is no longer a question of what happens behind closed doors but that the outside world is watching.  This can often be a force for good.  If however there is violence or harassment in the home, then it is advisable in the first instance to immediately call the Police, then call your Solicitor and to also seek medical help if appropriate.  An immediate Application can be made to Court for an injunction and may be also for an Order to make the violent party vacate the property for as long as necessary.
