Question

Will I be able to keep the family house when I get divorced?

Answer

This depends on the size of the property and its value compared with the other assets in the marriage and the needs of the parties.  If, for example, there are children and you are going to need to house the children and if selling the property means that it would be difficult to find enough money to re-house the children, then the Court is less likely to agree to the house being sold.

In many cases, the house would be transferred to the person living in the property with the children and the other spouse would either take their share in the equity from other assets or have to wait to be paid out at a later date.
