Our team is experienced in both pursuing and defending negligence claims involving a variety of professionals, including fellow solicitors, accountants, architects, surveyors, auditors and financial advisers.
We advise clients on the obligations imposed on them by the Pre-Action Protocol for Professional Negligence, as well as guide them through the litigation process if Court proceedings become necessary. We are able to identify and instruct suitable expert witnesses, and we are also experienced in settling professional negligence disputes through the use of Alternative Dispute Resolution (ADR) methods.
Notable recent professional negligence instructions include:
- acting for beneficiaries in respect of the alleged negligent administration of an estate by solicitors, including claims for overcharging, loss of tax reliefs and inordinate delay in winding up the estate;
- advising former shareholders in respect of a claim against their financial advisers arising from a negligent valuation of their shareholdings;
- acting for solicitors accused of negligence in relation to the purchase of a company;
- representing a property developer in respect of a claim against an architect for negligently prepared drawings for a building project;
- acting for a purchaser in respect of a claim against solicitors for negligent advice in relation to a property transaction.
