Construction disputes
We act for a number of clients within the construction industry, including both contractors and subcontractors, in respect of contractual disputes and adjudications. We also act for several other clients who employ contractors in relation to construction projects, such as ground works and similar sub-contract works.
We are experienced in advising on a variety of issues relating to JCT construction contracts, including adjudications under the Construction Act 1996. We also advise related third parties, such as consultant designers, on issues such as design liability, collateral warranties and insurance cover.
Examples of recent instructions in relation to construction disputes include:
- acting for residential developers in relation to an injunction brought in respect of the construction of foundations by adjacent residents
- representing a Dutch based international engineering/construction company on an adjudication concerning a major contract for the construction of a national chain of petrol stations
- advising an education trust in relation to the completion of a construction project following the administration of the contractor, including successfully pursuing a claim against the relevant bondsman
- acting for a subcontractor in relation to a claim against the contractor for loss and expense and for off site materials following suspension of work.
