Intellectual property and brand protection

We represent several well-known national and international brand owners operating in a variety of sectors, including IT, electronics, luxury goods, manufacturing, vehicle distribution, and pharmaceutical/healthcare.  We assist our clients with protecting and policing their intellectual property rights (IPR), including their:

  • Trade marks
  • Patents
  • Copyright
  • Design rights
  • Domain names.

Where infringement of a client’s IPR is suspected, our team is able to advise on all aspects of the dispute resolution process, including (as appropriate) Cease & Desist Letters, pre-action Letters of Claim, applications for injunctive relief (including Search Orders, Disclosure Orders and Freezing Orders), and bringing or defending Court proceedings.

We are also experienced in specialised IPR procedures, such as the Intellectual Property Office’s dispute resolution process, Nominet’s domain name Dispute Resolution Service and ICANN’s Uniform Domain Name Dispute Resolution Policy.  Our team also has a great deal of experience in the use of mediation as an effective means of resolving IPR disputes.

Where clients have frequent IPR infringement issues, we can also develop tailored IPR enforcement strategies that may include, for example, a combination of civil recovery through the Courts, liaising with Customs authorities (including setting up customs monitoring applications in the UK and Europe to stop suspect goods before they reach their destination), and liaising with Trading Standards to support their own investigations.

By focusing on our client’s commercial needs and objectives, we often use a combination of approaches to obtain the most commercially sensible solution for our client.  By working closely with our non-contentious colleagues in our Commerce & Technology team, we are able to offer a holistic intellectual property and brand protection service, covering IPR protection, commercial exploitation, management and enforcement.
